Is there a reg that talks about receiving BAH (military housing allowance) for a previous base??
My family just moved from Florida to small town New Mexico (Air Force move). We bought a house in Florida two years ago that, because of the crappy housing market, we can’t sell. I’ve heard that there is an AFI (Air Force Instruction) that says something about recieving the BAH rate from your previous station but no one knows what I’m talking about. It might not exist but I figured I’d see if anyone here might know about it. In addition, anyone know what reg talks about BAH? If I can find that out, at least I have somewhere to start.
The "Instruction" is the Joint Federal Travel Regulation (JFTR)chapter 10.

The navy instruction explicitly states that BAH is for your area of duty. I am pretty sure that is a DOD wide policy as well.

Never heard of that one, sorry. It does state that you wil recieve BAH for the area of your current rescidency though. That is figured out by using your zip code from your base of assignment. Think that one might have been some advice from a barracks lawyer there.

To find the reg you might want to check with your legal department. As far as I know you get BAH from current residence zip code only.

BAH is payed based on the location of your dependents. So if your dependents are living in town A but you own a house in town B BAH is payed for town A

You will receive your previous duty stations BAH for one month and that is it. It is the month that you are PCS’ing from the old command to the new one. On top of that you will receive your DLA, dislocation allowance. Other than that you are up a creek it looks like. DFAS and the DOD are very strict on guidelines for BAH and all services use the same regs for financial stuff, all regs for this are located in the DOD-FMR chaper 5 or 7. You need to get a good realtor who can rent your place quickly or get it sold. The military covers our butt’s on a lot of things, but a poor or failing real estate market is not one of them. Sorry.
The guy above who says BAH is based on deps location is very wrong. It is based on paygrade and zip code of your current command. IF you are deployed you may get a waiver if your family leave the command area, but you need that approved first.

The only time you will get BAH based on the rate of your previous command is when you are PCSing. As soon as you check into your new command, the BAH will be based on your zip code. If you are living in military housing that isn’t PPV then you won’t see the BAH at all. The military is also now frowning on Geo-Bachelors in which it is their choice to live apart in 2 areas. Before it would be possible to live in barracks for free and collect BAH, but now it isn’t. You must either pay for barracks or get a place out in town plus pay the rent or mortgage where your spouse is. The only time the BAH will change to another location is when you are IA or deployed and they will grant the waiver for it.
